Professors cited in carbon tax decision

Professor Nigel Bankes and Professor Emeritus Alastair Lucas were cited in the Alberta Court of Appeal's decision on the federal carbon pricing law.

Nigel and Alastair's article Kyoto, Constitutional Law and Alberta’s Proposals,” (2004) 42 Alta L Rev 355 was cited in the February 24 decision from the Alberta Court of Appeal, which stated that the federal government's carbon pricing law is unconstitutional.

Nigel and Alastair's article examines Alberta’s Bill 37, a provincial plan to reduce greenhouse gases and climate change, and explores the constitutionality of such legislation.
